Can I Change Buyer’s Agents in Massachusetts?

How to change Massachusetts buyer’s agents cleanly: review your agreement, contact the brokerage, get a written release, and avoid overlapping obligations.

Start with the agreement, not a new agent

Find the signed buyer-agency agreement and any amendments. Check its expiration, exclusivity, cancellation method, compensation terms, dispute process, and protection period. An uncomfortable working relationship is worth addressing quickly, but signing with someone else before resolving the first agreement can create overlapping obligations.

Decide what needs to change

Sometimes the problem is communication and can be fixed with a direct conversation: clearer search criteria, a response-time expectation, or a scheduled check-in. If the fit is wrong, say so plainly and ask for a release.

Because a Massachusetts salesperson acts through a brokerage and the buyer’s agency relationship is generally with the broker of record, changing the individual agent within the same company may not end the brokerage agreement. Ask whether you want reassignment inside the firm or a full release from the brokerage.

Get the outcome in writing

Massachusetts buyer-agency guidance recognizes expiration and mutual agreement to terminate or rescind. Ask the person authorized by the brokerage to confirm the effective end date and exactly which obligations survive.

  • Whether the brokerage releases you from exclusivity
  • Whether compensation remains possible for identified properties
  • The start and end of any protection period
  • Status of active showings, offers, deposits, and confidential information
  • Whether documents may be transferred to a replacement agent with your permission

Handle active properties carefully

Tell the brokerage if you have toured, discussed, or offered on a home. A protection clause or an accepted offer can make the situation more complicated. Do not ask a replacement agent to rewrite the same offer or negotiate with the listing agent until roles are clear.

If you are already under contract to buy, changing agents does not cancel the purchase contract or its deadlines. Keep the lender and closing attorney informed about contact changes while continuing to meet inspection, financing, deposit, and closing obligations.

If the issue is conduct, not fit

Bring service concerns to the broker of record first when practical. Preserve the agreement, disclosure forms, emails, texts, and a timeline. Massachusetts provides a complaint process for alleged violations by licensed brokers or salespersons, but a licensing complaint is different from obtaining a contractual release or resolving a fee dispute.

Make the next relationship clearer

Before hiring a replacement, explain what did not work and interview for the service you want. Confirm the new agent has seen the written release or expiration and understands any protected properties. Then put communication, scope, duration, compensation, and cancellation terms in writing from the start.
