Disclosure before purchase

Massachusetts and federal rules require a notification package for prospective purchasers of homes built before 1978. It includes warnings, seller disclosures about known lead hazards and records, and acknowledgments by the parties and agents.

A home inspection does not test for lead

General home inspectors identify visible conditions but do not determine whether paint contains lead unless separately licensed and engaged for that work. A licensed lead inspector can test and document lead hazards.

Responsibility after closing

Massachusetts requires the removal or covering of lead hazards in pre-1978 homes where a child under six lives. The owner is responsible.
